Building permit (autorizație de construire): step by step

The urbanism code applies from 25 August 2026. If you already have an urbanism certificate issued before that date, the approvals it requires follow the rules in force when it was issued.

The building permit is the administrative act issued by the town hall that allows you to execute the works, under the Codul urbanismului (Legea 169/2026).
Issuance deadlines
- General deadline: at most 30 calendar days from submitting the complete documentation.
- Emergency regime: at your request, the permit is issued within at most 7 working days. The town hall may charge a special fee for this regime.
- If you chose to obtain the avize through the Single Approval Commission (Comisia de acord unic), the 30 days are calculated from the date the single approval is issued, not from the initial submission.
If the documentation is incomplete
The town hall notifies you in writing, within at most 10 working days of registration, of all the deficiencies found. The same notification tells you the deadline by which you must complete the dossier: which cannot exceed 3 months. If you do not complete it in time, the town hall returns the dossier to you. You can complete it and file it again while the urbanism certificate is still valid (art. 273 para. 5).
What the dossier contains
- The request for issuing the permit (standard form set by ministerial order).
- Extract of the cadastral plan and extract of the land register (carte funciară), both updated, no older than 30 days.
- Proof that the project is registered with the Romanian Order of Architects (for buildings).
- The project for authorising construction (PAC): the documentation previously called DTAC.
- Complementary documentation for obtaining the avize through the Single Approval Commission (Comisia de acord unic), if applicable.
- The environmental authority's point of view or administrative act, and the environmental agreement, if applicable.
- The other avize and agreements required by the certificat de urbanism.
- The technical expert report on the impact on neighbouring properties, if applicable.
- The general cost estimate (deviz general), the execution period and the value of the investment.
Site organisation
The permit for organising the execution (autorizația de amenajare a organizării execuției) is issued for the provisional preparatory works needed to execute the project: both on the investment land and on spaces temporarily occupied outside it. The documentation was previously called DTOE.
It can be requested either together with the building permit or separately, by the general contractor. The documentation includes the memoriu tehnic, the site plan and the road administrator's aviz, or the documentation for occupying public land, if applicable.
Neighbours' agreement
It is required, in authenticated form, only when carrying out the works requires safety measures for existing buildings, identified through technical expert assessment.

Frequently asked questions
How long does obtaining the building permit take?
The law provides for issuance within at most 30 days from submitting the complete dossier. On top of that comes the time for the certificat de urbanism, the avize and preparing the technical documentation.
How long is the building permit valid?
The building permit is valid for 3 years from issuance, during which you must start the works. This deadline cannot be extended, but it can be suspended once, for at most 12 months. The execution period is extended separately, once, by at most 12 months. After you announce the start of the works, validity automatically extends for the execution period set out in the permit.
Which works can be done without a permit?
The law exempts certain minor works, such as some repairs and finishes that do not change the structure or the architectural appearance. The exact list is in the Codul urbanismului (Legea 169/2026); when in doubt, ask the town hall.
How much does the building permit cost?
The fee is calculated as a percentage of the declared or estimated value of the works, under the Fiscal Code and the local council decisions. Add the certificat de urbanism fee and the aviz fees.
