Independence defined by what you may not be

The code never says what an independent check of a building is. Four times over, it says who may not carry one out. The difference shows on small sites.

Read the code by role rather than by chapter and a pattern appears that no single article states. Wherever the law creates a check, it does not describe what the person is supposed to check. It describes who they are not allowed to be at the same time.

Four prohibitions, one shape

Article 449 paragraph (2): the same authorised legal person that produced the project being verified cannot act as its technical verifier, whatever the contractual relationship between the two entities, employee or contractor. That closing phrase shuts the usual door, the separate company staffed by the same people.

Article 454 paragraph (3): the site supervisor’s activity is incompatible with any design, execution, verification or expert activity on the works where he acts as supervisor.

The same rule turns up in technical expert reports, where whoever produced the project may not report on it; we wrote about that in technical expert reports on existing buildings. Four places, four wordings, one idea: verification is defined negatively.

Who pays whom

The rule only becomes interesting read alongside the contractual relationships, because there the code is explicit and asymmetric.

The site supervisor works as employee or contractor of the developer or the client, independent of the other parties involved, says article 454 paragraph (2). The technical officer for execution, by contrast, works as employee or contractor of the contractor, at article 457 paragraph (2).

The two roles look alike from outside and sit on opposite sides of the table. One is yours. The other is the builder’s. If someone offers to supply both, you have already read why that is not the same thing.

The detail that shows what kind of independence this is

Article 459 paragraph (3) says the State Inspectorate for Construction may authorise one person simultaneously as site supervisor and as technical officer for execution, that person then exercising either profession depending on the contracts they are engaged under, subject to the incompatibility regime.

So independence is not a quality of the person. It is a relationship, tested per works and per contract. The same person may lawfully sit on one side of the table in one project and on the other in the next.

I think the system is well built and that it will be applied unevenly, for reasons that have nothing to do with the text.

In a large city, with dozens of accredited verifiers and dozens of supervisors, the prohibition works because there is a pool to choose from. In a commune where the list of specialists authorised for a given requirement runs to three names, one of whom produced the design and another of whom usually works with the local contractor, the rule does not become false. It becomes expensive and slow. It is complied with by bringing someone in from 80 kilometres away.

That produces, I think, two effects worth watching over the first year. First, the cost of independence will be visibly different between urban and rural settings for the same works. Second, the real pressure will fall not on the verifier but on the client who has to find one, and who, unlike a developer, does this once in a lifetime.

I have no figures for either claim and do not pretend to. They are hypotheses that time can test, and the simplest signal to watch is how long it takes, in practice, to find a verifier outside the large cities.
