The forms changed. The websites did not

The code took effect on 25 August and the forms changed on the 26th. Many sources, ours included, still show the old models. Why that matters.

The Codul urbanismului, Romania’s planning and construction code, took effect on 25 August 2026. Article 576 repeals, among much else, Ordinul 839/2009, the implementing norms of Legea 50/1991 and with them the form models everyone used: F.1, F.8 and the rest. What the application’s technical annex now asks for, on the new form, is in the anexă tehnică. What changes in the procedure is on the Legea 169/2026 page.

Legal press reports that the next day, 26 August, a new set of forms became mandatory, approved by ministerial order. We were not able to verify that order against the official text, because the public portals do not answer us, so treat it as reporting rather than as a citation. Check with your own primărie, the local town hall, which form it accepts today.

What interests us here is different: what happens when the ground moves twice in two days.

Public information falls behind, systematically

A legal text changes instantly. Everything written about it does not. Town hall guidance, blog articles, forum answers, downloadable files on dozens of sites: all still describe the procedure as it was, because nobody rewrites them within 48 hours.

We include ourselves in that list. At the time of writing, our own pages about the cerere de certificat de urbanism and the cerere de autorizație de construire were built around the old forms. We are correcting them. We mention it because it is precisely the argument: if we, who follow this daily, were two days behind, a site last updated a year ago is somewhere else entirely.

What this means in practice if you are filing now

The risk is not that you read something out of date. The risk is that you have no way of telling that it is out of date. A downloaded form looks equally official whether or not its model is still in force. It has no printed expiry.

Three things that help, in order of usefulness:

  1. Ask at the counter which form is accepted today, not which one you downloaded last week. It is the only source that cannot be behind.
  2. Do not assume a file on a public website is current because it is on a public website. Check the date.
  3. If you have already filed, reporting suggests that files submitted earlier are decided under the rules in force on the date of submission. Confirm that with the registry office, though, not with us.

What we expect over the coming months

Divergence. One primărie accepts the new form, another the old one for a few weeks, a third asks for both “to be safe”. Not out of bad faith, but because updating their own systems runs on its own calendar and the people at the counter work with what they have.

This period will end. Until it does, the question “what do you require here” has a more useful answer than “what does the law say”.
